EU Launches Investigation into TikTok for Alleged Violations of Digital Services Act

EU Authorities Initiates Investigation into TikTok’s Alleged DSA Violations

EU regulators are swiftly taking action to enforce the new Digital Services Act (DSA) powers, as the European Commission has recently announced an inquiry into TikTok’s potential breaches of DSA regulations concerning the safeguarding of minors within the app.

The concerns raised surrounding TikTok’s compliance span various aspects, including the risks associated with app addiction, the effectiveness of its age verification procedures, the security measures in place for minors, data transparency protocols, and more.

According to the European Commission’s preliminary findings, based on an assessment of the risk report submitted by TikTok in September 2023 and the company’s responses to the Commission’s formal inquiries on illegal content, protection of minors, and data access, formal proceedings have been initiated under the DSA regulations.

This investigation marks the second significant probe under the DSA laws, with another platform also being scrutinized for its measures in restricting illicit content and combating the dissemination of misinformation.

TikTok is now required to furnish additional information to the EU investigators for evaluation, with the potential for penalties of up to 6% of its worldwide revenue if any violations are substantiated.

However, the DSA affords the possibility for TikTok to provide commitments to rectify the identified issues, which could mitigate the severity of any punitive actions imposed.

Given the nascent stage of the DSA’s implementation, the outcome of these initial inquiries may set a precedent for future enforcement actions, signaling the gravity of compliance with the new regulatory framework.

The duration and complexity of these investigations, alongside the level of cooperation from the company under scrutiny, will dictate the timeline and outcome of the proceedings, which could lead to prolonged uncertainty regarding potential penalties.

The enforcement of these regulations presents a challenge for EU authorities in ensuring adherence from all platforms to the stringent standards set by the DSA, particularly amidst varying interpretations of compliance requirements.

These early cases hold the potential to establish a benchmark for future enforcement actions, potentially resulting in substantial fines and compelling app operators to reassess their strategies within the region to align with regulatory expectations.

The past threats issued by Meta regarding potential withdrawal of Facebook and Instagram from Europe underscore the significance of compliance with EU regulations and the potential ramifications of non-compliance.

Overall, the ongoing investigations into TikTok’s practices under the DSA highlight the evolving landscape of digital governance and the imperative for platforms to align with regulatory standards to uphold user protection and data integrity.
