Capitol Rioter’s Supreme Court Victory Spells Trouble for Trump Case

A New York man caught up in the U.S. Capitol riot is celebrating a U.S. Supreme Court decision that could affect the trial of former President Donald Trump. On January 6, 2021, supporters of Trump stormed the Capitol building while Congress was confirming Joe Biden’s election victory. The incident followed unproven claims by Trump that the election was stolen due to widespread voter fraud.

More than 1,230 people have been charged in connection with the riot, including Edward Jacob Lang. Lang was arrested from his home in Newburgh, ten days after the riot. Lang had posted pictures and videos on social media placing himself outside the Capitol building on January 6, and he has been accused of a number of crimes including obstruction of an official proceeding, a felony for which he has pleaded not guilty.

Lang, along with two others, is appealing to the Supreme Court, arguing that federal prosecutors overreached in their obstruction law charges. The Supreme Court’s decision to hear similar cases could have a significant impact on Lang and his co-defendants’ trial.

While the court isn’t directly addressing Lang’s case, the decision to hear cases similar to his could have major implications for him. Lang’s lawyer expressed delight that the Supreme Court will hear the case, with hopes of preventing what he sees as overzealous prosecution by the Department of Justice.

If the Supreme Court were to agree with the Federal District Court’s dismissal of a portion of a co-defendant’s indictment under the obstruction law, it could potentially delay Lang’s trial and impact the broader legal landscape surrounding the Capitol riot.
