Federal prosecutors have made the decision to seek the death penalty against Payton Gendron, the man responsible for taking the lives of 10 Black people in a Buffalo supermarket in 2022. This comes after Gendron was previously sentenced to life without parole.

New details have emerged regarding the decision made by federal prosecutors. According to ABC News, prosecutors filed a petition on Friday, January 12, expressing their intention to pursue the death penalty against Gendron.
“United States believes the circumstances in Counts 11-20 of the Indictment are such that, in the event of a conviction, a sentence of death is justified,” the filing reportedly reads, per the outlet.
While the specific order of the counts remains unclear, Gendron was previously indicted on multiple counts related to hate crimes and the use of a firearm to commit murder.
The filing also highlighted Gendron’s expressed bias, hatred, and contempt toward Black persons and how his animus played a significant role in his actions during the shooting. It was noted that he specifically selected the supermarket location to target Black victims.
The Guardian reported that prosecutors also informed Judge Lawrence Vilardo of their filing, though Gendron was not present at this hearing. The next proceeding in the case is scheduled for February 2.
Attorneys For The Mass Shooter Weigh In On The Decision Along With Victims’ Family Members
ABC News shares that the defense attorneys for Grendon expressed their deep disappointment in the federal government’s decision to pursue the death penalty. They suggested that the effort would be better spent addressing other contributing factors to the crime, such as access to deadly weapons and the spread of hateful rhetoric on social media.
Family members of victims in the Buffalo supermarket shooting also shared their reactions to the prosecutors’ decision. Geraldine Talley’s son, Mark, expressed that he feels Gendron would be “getting off the hook” if he were to be sentenced to death.
Mark shared his belief that the death penalty would not bring the suffering he desires to see Gendron experience.
