Special Counsel Confirms: Biden Cleared of Charges on Classified Docs

President Joe Biden was found to have knowingly possessed and shared highly classified materials as a private citizen, including sensitive documents related to military and foreign policy matters in Afghanistan and other national security issues. However, a recent Justice Department report by special counsel Robert Hur concluded that there is no basis for criminal charges against him or anyone else involved in the matter.

The report, released on February 8, offers a critical evaluation of Biden’s handling of classified government materials but ultimately explains why legal repercussions are not warranted. This development may impact Biden’s ability to criticize his potential opponent in the upcoming presidential election, Donald Trump, who is facing allegations of unlawfully retaining classified documents at his Mar-a-Lago estate.

Following a thorough investigation into Biden’s retention of classified documents from his time as a senator and vice president, it was discovered that these materials were kept at his Delaware residence and a private office used during the transition between his vice presidency and presidency. This inquiry is distinct from another investigation led by special counsel Jack Smith focused on Trump’s handling of classified documents post-presidency.

Once Biden’s legal team identified the classified documents at his former office, they promptly alerted the National Archives to facilitate their return to government custody. Subsequently, the FBI launched an investigation, during which Biden cooperated by allowing agents to search his homes. This cooperation led to the uncovering of the most sensitive documents that were in question.

While Biden could not have faced prosecution as a sitting president, the report by Hur indicates that even under different circumstances, criminal charges would not be pursued against him. Part of the inquiry also delves into Biden’s possession of classified materials concerning Afghanistan, particularly documents related to the Obama administration’s troop deployment decision. These included a classified handwritten memo outlining Biden’s opposition to the troop surge, considered a pivotal moment of his vice presidency.

Despite the classified nature of the documents, Biden’s preservation of these materials was deemed as a reflection of his stance on a significant policy issue. The documents were marked with high levels of classification and were stored in a secure manner at his Delaware residence.
