Legal Declaration of Harmony Montgomery’s Death

On Tuesday, a judge in New Hampshire officially declared Harmony Montgomery, who has been missing for over four years, legally dead. This ruling came as a result of the request from her biological mother, Crystal Sorey, and now opens the path for potential wrongful death claims.

Despite Harmony’s body never being recovered and no one having seen her since 2019, Sorey appeared in court advocating for her daughter’s death declaration. The court’s decision, without issuing a death certificate due to the absence of Harmony’s remains, specifies that Harmony is to be considered “presumed dead” pending an authenticated jury verdict in her father’s murder case.

The father, Adam Montgomery, was recently found guilty in Boston for the murder of Harmony, with additional charges related to assault, abuse of a corpse, and other offenses. Although Harmony’s custody was taken away from Sorey in 2018 following substance abuse issues, she has now been appointed as the administrator of Harmony’s estate, contemplating the pursuit of wrongful death lawsuits against both New Hampshire and Massachusetts.

Sorey emphasized her role as Harmony’s advocate, expressing her determination to seek justice and hold accountable not only the individuals directly involved in Harmony’s tragic fate but also the child welfare systems in the two states. Testimony from Montgomery’s estranged wife revealed further disturbing details, including her presence during Harmony’s death and participation in concealing the child’s body. Additionally, it was disclosed that she unlawfully received financial benefits intended for Harmony after her demise.
